The following are a few examples of Mr. Coopersmith’s recent significant cases:
- Representing former executive of real estate management company, obtained favorable settlement for client with employment claims against former employer through mediation prior to filing suit.
- Obtained highly favorable settlement of False Claims Act whistleblower case resulting in recovery of nearly full measure of damages to U.S. Government, plus attorneys' fee reimbursement to client and share of U.S. Government recovery.
- Represented national mortgage company in wage and hour and other employment-based claims by former executive and obtained highly favorable resolution for less than 1 percent of plaintiff's damages demand.
- Obtained favorable settlement in internal LLC dispute in which client had been locked out of company by other LLC member and denied access to records and company earnings.
- Obtained highly favorable resolution for surgeon who had been denied stock option rights granted by public medical technology company
- Successfully enforced settlement and obtained and collected judgment for reimbursement of full measure of client’s attorney’s fees for enforcing the settlement in dispute between two dentists concerning office lease and dental office technology and equipment
- Obtained favorable settlement for client in whistleblower and employment discrimination lawsuit.
- Obtained stipulated judgment for real estate plaintiffs in fraud and breach of contract suit during trial for virtually full measure of damages.
- Obtained favorable settlement for seller of prominent art gallery litigating to recover amount due from buyer, and defending against fraud and other tort claims.
- Assisted in obtaining summary judgment in dispute between large cable and satellite companies concerning right to provide service to large apartment complex. See Time Warner Entertainment-Advance/Newhouse Partnership d/b/a Time Warner Cable v. Steadfast Orchard Park, L.P, 2008 WL 4350054 (C.D. Cal. 2008).
- Working in conjunction with counsel for other defendants, obtained dismissal of claims involving sales tax charges to consumers purchasing cellular phones. See Laster v. T-Mobile USA, Inc., 407 F.Supp.2d 1181 (S.D. Cal. 2005).
- Assisted in obtaining favorable result in arbitration of dispute between venture capital investment partners.
- Represented local hospital in contract dispute with large insurance company.
- Assisted in obtaining total dismissal of claims on behalf of governmental entity in litigation involving proposed $600 million development project, and successfully defended judgment on appeal. See Tuchscher Development Enterprises, Inc. v. San Diego Unified Port District, 106 Cal. App. 4th 1219, 132 Cal. Rptr. 2d 57 (2003).
- Obtained highly favorable settlement for online computer seller facing fraud, and copyright and trademark violation allegations from large software company.
- Obtained highly favorable settlement for originating mortgage company in contract and negligence suit.
- Obtained favorable settlement for senior executive of international corporation involving right to stock options and other benefits.
- Obtained favorable settlements in several NASD/FINRA arbitrations involving various aspects of securities and investment field.
- Provided advice to, and obtained favorable results for, employers and employees in litigation and other disputes arising from employment and rights to stock options and retirement benefits.
- Obtained favorable result in arbitration of dispute between venture capital investment partners.
- Obtained favorable settlement on eve of trial for general partners and real estate partnership in dispute with minority partner regarding dissolution and sale of assets.
